Petition for the Release of Alejandro Mendez Vargas

As a result of medical malpractice and negligence, our precious baby Lucas Mullenax-Mendez was taken from us. As if the tragedy of losing our only child wasn’t enough, the treating physicians accused my husband, Alejandro and me, of 'Shaken Baby Syndrome' in order to avoid a potential malpractice suit.

The police conducted their inept investigation into our baby’s death for 11 ½ months, and to our further disbelief, Alejandro and I were the primary suspects of their investigation! Although our attorney had requested that we hand ourselves in to the authorities in the event that we were going to be arrested, the state refused to cooperate with this request. Instead, in August of 2003, (nearly a YEAR after we lost our son), approximately 15 armed police, detectives, and SWAT surrounded my parents’ house and indicted my husband. Currently, Alejandro is facing charges of 1st and 3rd degree murder for the death of our precious angel Lucas. The District Attorney, Ray Gricar, is seeking the death penalty! Alejandro has been incarcerated since they took him away. My husband has absolutely no prior history of violence, nor a criminal record. He loved his son more than anything in the world.

Alejandro is 100% innocent and we have the medical evidence that proves this to be so. There is absolutely no reason to hold him for trial when we already have key medical evidence that exposes the blatant negligence and incompetence of the physicians who were responsible for our baby’s care. Please go to our web-site at www.freemendez.org to read Lucas’s toxicology/pathology report written by Dr. Mohammed Al-Bayati. The medical evidence speaks for itself. Other physicians have reviewed our case without compensation and concur with Dr. Al-Bayati’s findings. They too conclude that Alejandro is innocent.

After reading our story, you can help us by signing our petition to free Alejandro. He has been wrongfully incarcerated since August 11th, 2003 as a result of the malpractice committed by the treating physicians, which consequently led to these bogus charges being filed. Bond is not an option due to the charges that were placed against him.

Please join myself, Alejandro, our families, friends, and medical experts in requesting that the District Attorney’s Office of Centre County, Pennsylvania FREE AN INNOCENT MAN. The state of Pennsylvania is committing a grave miscarriage of justice. In the prosecutors’ over-zealousness for a conviction, along with their pursuit for 'justice,' they are persecuting an innocent man. FREE ALEJANDRO MENDEZ! An innocent man’s life is at stake. He has already suffered the loss of his only son and should not be further victimized by these heinous and false allegations.
